This book was released on 1989-09-21 with total page 808 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Spirit of the Laws is, without question, one of the central texts in the history of eighteenth-century thought, yet there has been no complete, scholarly English-language edition since that of Thomas Nugent, published in 1750. This lucid translation renders Montesquieu's problematic text newly accessible to a fresh generation of students, helping them to understand quite why Montesquieu was such an important figure in the early enlightenment and why The Spirit of the Laws was, for example, such an influence upon those who framed the American constitution. Fully annotated, this edition focuses attention upon Montesquieu's use of sources and his text as a whole, rather than upon those opening passages towards which critical energies have traditionally been devoted, and a select bibliography and chronology are provided for those coming to Montesquieu's work for the first time.

Available in PDF, EPUB and Kindle. Book excerpt: This treatise on political theory, originally published anonymously in 1748, has become one of the most influential works of political science ever written. French philosopher Charles de Montesquieu wrote this piece under the inspiration of such political theorists as René Descartes, Nicholas de Malebranche, and Niccolò Machiavelli. The ideas laid forth by Montesquieu in this work, especially that of balancing power among branches of government, had a prominent influence on the American Constitution, although at the time of its publication was subject to censorship. Over twenty years in the making, "The Spirit of Laws" considers a vast range of political topics including: the preservation of civil liberties, taxation, slavery, commerce, the role of women, crime and punishment, religion, education, morality and the law, and other matters of political, sociological, and anthropological importance. Undoubtedly, it has become one of the most emulated and highly-regarded treatises on political law ever written. This edition is printed on premium acid-free paper.

This incisive critique was written around 1807 by Tracy [1754-1836], a French philosopher and path-breaking psychologist who was a friend of Jefferson [1743-1826]. Jefferson saw the Commentary when it was still a manuscript and was so impressed that he took pains to have it printed. He even helped with the translation and corrected the page proofs. Although the translation was published anonymously, we can identify the author and translators through a letter by Jefferson dated January 26, 1811. Elsewhere in this letter he commends it for correcting the Spirit of the Laws. While other studies had merely "nibbled only at its errors...This want is now supplied, and with a depth of thought, recision of idea, of language and of logic, which will force conviction into every mind. I declare to you, Sir, in the spirit of truth and sincerity, that I consider it the most precious gift the present age has received.": The Writings of Thomas Jefferson V:566-571.

Available in PDF, EPUB and Kindle. Book excerpt: The Spirit of Japanese Law focuses on the century following the Meiji Constitution, Japan's initial reception of continental European law. As John Owen Haley traces the features of contemporary Japanese law and its principal actors, distinctive patterns emerge. Of these none is more ubiquitous than what he refers to as the law's "communitarian orientation." While most westerners may view judges as Japanese law's least significant actors, Haley argues that they have the last word because their interpretations of constitution and codes define the authority and powers they and others hold. Based on a "sense of society," the judiciary confirms bonds of village, family, and firm, and "abuse of rights" and "good faith" similarly affirms community. The Spirit of Japanese Law concludes with constitutional cases that help explain the endurance of community in contemporary Japan.

Available in PDF, EPUB and Kindle. Book excerpt: As our society becomes more global, international law is taking on an increasingly significant role, not only in world politics but also in the affairs of a striking array of individuals, enterprises, and institutions. In this comprehensive study, David J. Bederman focuses on international law as a current, practical means of regulating and influencing international behavior. He shows it to be a system unique in its nature--nonterritorial but secular, cosmopolitan, and traditional. Part intellectual history and part contemporary review, The Spirit of International Law ranges across the series of cyclical processes and dialectics in international law over the past five centuries to assess its current prospects as a viable legal system. After addressing philosophical concerns about authority and obligation in international law, Bederman considers the sources and methods of international lawmaking. Topics include key legal actors in the international system, the permissible scope of international legal regulation (what Bederman calls the "subjects and objects" of the discipline), the primitive character of international law and its ability to remain coherent, and the essential values of international legal order (and possible tensions among those values). Bederman then measures the extent to which the rules of international law are formal or pragmatic, conservative or progressive, and ignored or enforced. Finally, he reflects on whether cynicism or enthusiasm is the proper attitude to govern our thoughts on international law. Throughout his study, Bederman highlights some of the canonical documents of international law: those arising from famous cases (decisions by both international and domestic tribunals), significant treaties, important diplomatic correspondence, and serious international incidents. Distilling the essence of international law, this volume is a lively, broad, thematic summation of its structure, characteristics, and main features.

Available in PDF, EPUB and Kindle. Book excerpt: Few thinkers have enjoyed so pervasive an influence as Rousseau, who originated dissatisfaction with modernity. By exploring polarities articulated by Rousseau—nature versus society, self versus other, community versus individual, and compassion versus competitiveness—these fourteen original essays show how his thought continues to shape our ways of talking, feeling, thinking, and complaining. The volume begins by taking up a central theme noted by the late Allan Bloom—Rousseau's critique of the bourgeois as the dominant modern human type and as a being fundamentally in contradiction, caught between the sentiments of nature and the demands of society. It then turns to Rousseau's crucial polarity of nature and society and to the later conceptions of history and culture it gave rise to. The third part surveys Rousseau's legacy in both domestic and international politics. Finally, the book examines Rousseau's contributions to the virtues that have become central to the current sensibility: community, sincerity, and compassion. Contributors include Allan Bloom, François Furet, Pierre Hassner, Christopher Kelly, Roger Masters, and Arthur Melzer.
